Terms and Conditions

National Membership Terms & Conditions — applicable to all Kiddies Aqua Swimming Academy™ branches.

Please read this agreement carefully before enrolment

This document sets out the full National Terms & Conditions of membership with Kiddies Aqua Swimming Academy™ ("KASA"), including how we handle your personal information and your rights and responsibilities as a KASA member. By completing enrolment, you agree to the Terms & Conditions set out below. A copy of this document is available to you for your records at any time.

These national terms apply at every KASA branch. Fees, banking details for EFT payments, lesson scheduling, bookings, and day-to-day contact details are branch-specific — always refer to your branch's page on our website, or contact your branch directly.

1. Your Information

As part of enrolling a swimmer, we ask for the swimmer's details (name, surname, age, date of birth), medical information relevant to their safety, and — where the swimmer is a minor — the details of the parent(s)/guardian(s) responsible for the account, including contact details, ID numbers, and preferred method of correspondence.

2. Health & Medical Information

We ask whether the swimmer has any relevant neurodiverse conditions, chronic health conditions, physical or sensory impairments, mental health conditions, or allergies (including Autism Spectrum Disorder, ADHD, Sensory Processing Disorder, Dyspraxia, Tourette Syndrome, Asthma, Diabetes, Ehlers-Danlos Syndrome, Cystic Fibrosis, Visual/Hearing Impairment, Mobility Impairments, Non-verbal Communication, Cerebral Palsy, Epilepsy, Anxiety Disorders, and Post-Traumatic Stress Disorder).

We ask for this information solely so our instructors can adapt lessons safely for the swimmer — for example, adjusting pacing for sensory sensitivities or preparing appropriately for a medical event. This information is shared only with the instructor(s) and management directly responsible for the swimmer's safety and is not used for any other purpose without your further consent.

3. Privacy Notice (POPIA)

This notice explains how KASA processes your personal information in line with the Protection of Personal Information Act, 2013 (POPIA).

What we collect: Swimmer and guardian identifying information, contact details, banking/payment reference details, and — where applicable — health information as described in Section 2.

Why we collect it: To register and manage the swimmer's membership; to invoice and collect swimming fees; to communicate with you about lessons, cancellations, weather closures, and holiday schedules; to make appropriate safety accommodations during lessons; and, where you separately consent (Section 4), for promotional and marketing purposes.

Who we share it with: KASA staff and instructors directly involved in the swimmer's care, and our online payment processor, PayFast (Pty) Ltd, for fee collection. We do not sell or rent your information to third parties, and we only share it with regulators or law enforcement where legally required to do so.

Minors' information: Where the swimmer is a minor, this information is processed with the consent of a parent or legal guardian, as required under POPIA.

How long we keep it: We retain membership and financial records for as long as the swimmer is enrolled, plus the period required by South African tax and record-keeping legislation, after which records are securely destroyed.

Your rights: You may at any time request access to the personal information we hold about you or the swimmer, request correction or deletion of inaccurate information, object to processing, or withdraw consent (noting this may affect our ability to continue providing lessons).

Complaints: If you believe we have processed your personal information unlawfully, you may lodge a complaint with the Information Regulator (South Africa) at enquiries@justice.gov.za.

4. Photography & Marketing Media Consent

From time to time, we take photographs or videos of swimmers during lessons for use on our social media, website, or promotional material. This is entirely optional, and declining will not affect the swimmer's enrolment or the services we provide. Consenting to KASA photographing/filming the swimmer, or declining to do so, is indicated separately as part of your enrolment.

5. Indemnity & Assumption of Risk

Please read this section carefully — it affects your legal rights. By agreeing to these Terms & Conditions, the signatory confirms that:

Assumption of Risk: Swimming and related aquatic activities carry inherent risks, including but not limited to drowning, slipping, and injury, and I accept these risks on behalf of myself and/or the swimmer or the swimmer in my care.

Premises: I attend KASA premises at my own risk. Branch-specific premises details are available on our website and at each branch.

Physical Fitness: I confirm the swimmer (or the swimmer in my care) is in a suitable physical and mental condition to participate, having consulted a medical practitioner where necessary.

Instructions: I agree to comply with all KASA instructions, warnings, and directions given by staff at any time.

Cancellations: I acknowledge KASA may cancel, postpone, or curtail any activity at its reasonable discretion (for example, for safety or weather reasons), without liability for such decisions.

Indemnity: To the maximum extent permitted by South African law, I indemnify and hold harmless KASA, its branch associations, affiliated partners, sponsors, officials, servants, and employees against claims for loss, damage, illness, injury, or death arising from participation in KASA activities, save where such loss, damage, illness, injury, or death arises from the gross negligence or intentional misconduct of KASA, its staff, or agents.

Transport: I indemnify KASA and its contracted transport provider against claims arising from transporting the swimmer to and from a pre-school, where such a transport service is provided.

If you are signing on behalf of a minor: if you are under 18, a parent or legal guardian must complete this section on your behalf. If you are signing on behalf of a minor swimmer who is not part of your immediate family, you must provide a written mandate or resolution authorising you to do so, or ensure that the swimmer's own guardian signs a copy of this indemnity directly.

6. Membership Rules of Conduct

1.Silence is expected during lessons in progress; no cell phones inside the pool area.
2.Please do not enter the pool area while another class is in progress.
3.No compensation, credit, or make-up lessons are given for absences due to personal reasons, public holidays, or school holidays. Fees remain payable.
4.Please give advance notice of an absence to your branch via SMS or WhatsApp — contact details for your branch are available on our website.
5.Please be prompt for the swimmer's allocated lesson time.
6.KASA reserves sole discretion to cancel lessons due to weather conditions; no make-up lessons apply in these cases.
7.Parking is permitted only inside or in front of the premises, not on neighbouring properties.
8.KASA and its employees are not held responsible for injury or loss of any kind on or outside the premises.
9.Smoking is prohibited on the premises; no eating or drinking in the indoor pool area.
10.Please check your branch's notice board and communications regularly for updates.
11.Lesson duration: 20 minutes (Learn-to-Swim); 5–15 minutes (Baby Floating, depending on the baby's progress).
12.Trading hours: Monday–Friday 08:00–19:00; Saturday 08:00–13:00. Branch hours may vary — please confirm with your branch.
13.Holidays: three annual breaks — one week over Easter, two weeks in June/July, and one month over December/January. Fees remain payable during these breaks. Two five-day holiday camps are offered in late November and early December.

Fee Structure & Financial Obligations

Fees vary by branch and programme. Please refer to your branch's page on our website, or contact your branch directly, for the current fee structure applicable to you. Discounts are available for families with three or more swimmers. Proof of payment should be submitted to your branch — contact details for your branch are on its page.

1.Fees are charged monthly, strictly payable in advance. Invoices are issued electronically on the 25th of each month for the following month, payable within 7 days.
2.Holding fee: if the swimmer does not take part in one of the two year-end holiday camps, a full month's holding fee applies for the new swim year. A 50% holding fee applies if lessons are paused over winter to retain a summer time slot, given demand on our waiting lists.
3.Termination: one calendar month's written notice is required to cancel lessons, submitted in writing (email or WhatsApp) to your branch. Fees remain payable for the full notice month, during which the swimmer may continue attending.
4.Annual fee increases take effect only in January of each year.
5.Interest of 2% per month may be charged on accounts unpaid 30 days past their due date.
6.Charges may escalate annually, effective each January.

EFT Banking Details

Banking details are branch-specific. Please refer to your branch's page on our website, or contact your branch directly, for the correct banking details to use for EFT payments.

Reference: the swimmer's full name and surname, or invoice number.

Online payments: where online payment is offered, it is processed securely by PayFast (Pty) Ltd, a PCI-DSS compliant South African payment gateway. KASA does not store your card details.

7. Fee Payment Mandate & Declaration

I, the person named as the fee-liable party, confirm and agree that:

1.I acknowledge KASA as the provider of swimming lessons to myself and/or the swimmer(s) in my care.
2.I agree to pay the applicable monthly fee for the specific service selected (Baby Floating and/or Learn-to-Swim, at the selected weekly frequency), payable for every month I make use of the service, including December.
3.I remain liable for payment unless otherwise agreed in writing, and accept the invoicing, interest, escalation, and termination terms set out under Fee Structure & Financial Obligations above.
4.I understand that non-payment entitles KASA to suspend lessons until my account is settled.
5.The address and contact details I have provided constitute my domicilium citandi et executandi for legal notices, and I undertake to update KASA in writing within 14 days of any change.

Final declaration: By enrolling with Kiddies Aqua Swimming Academy, I confirm that all information I have provided is true and correct, and that I have read and agree to the Terms & Conditions set out in this document in full.
